Na advies van de VLOR en van de Raad van State hecht de Vlaamse Regering haar definitieve goedkeuring aan het ontwerpdecreet over de alternatieve financiering van schoolinfrastructuur via projectspecifieke DBFM-overeenkomsten. In het ontwerpdecreet is vooreerst voorzien dat het toepassingsgebied ongewijzigd blijft ten opzichte van het DBFM-programma Scholen van Morgen: zowel de instellingen voor gewoon en buitengewoon basis- en secundair onderwijs en het volwassenenonderwijs als de internaten en centra voor leerlingenbegeleiding komen in aanmerking voor een DBFM-toelage. Zij dienen eigenaar te zijn van het overeenkomstige onroerend goed of hierop over een zakelijk recht beschikken zodat het genot van het goed verzekerd is tot minstens de einddatum van de DBFM-overeenkomst. Er is niet langer expliciet voorzien dat de inrichtende machten een zakelijk recht moeten verlenen. De beschikbaarheidsperiode blijft behouden op 30 jaar vanaf de oplevering van het DBFM-project. Het ontwerpdecreet wordt nu ingediend bij het Vlaams Parlement.

PPP School Infrastructure

After the VLOR and the State Council submitted their advice, the Flemish Government gave her final approval to the draft Flemish Decree on the alternative financing of school infrastructure through project-specific DBFM contracts. The draft provides for a start that the scope remains unchanged from the DBFM program Schools for Tomorrow: both the settings for all primary and secondary education and adult education as boarding schools and pupil guidance centres are eligible for an DBFM -allowance.
These entities are required to be owner of the corresponding property or having a right in rem so that the enjoyment of the property is insured at least until the expiry of the DBFM-contract. No longer it is explicitly provided that the governing bodies should grant a right in rem. The availability period is maintained at 30 years from the completion of the DBFM-project. The draft will be submitted to the Flemish Parliament.
